Nebraska has taken a major step toward legalizing online sports betting, as the Secretary of State’s office has officially approved two ballot petitions that could reshape the state’s gambling landscape. If supporters gather enough signatures before the July deadline, Nebraskans will have the chance to vote on online sports wagering during the November 2026 general election.
This marks the most significant movement on Nebraska sports betting since voters approved in‑person wagering at casinos back in 2020 - and it could finally bring mobile betting to a state where legislative efforts have repeatedly stalled.
Two Petitions, One Goal: Legal Online Sports Betting
The Secretary of State approved two separate petitions, each serving a different purpose:
1. Constitutional Amendment Petition
This proposal would amend Nebraska’s constitution to formally legalize online sports betting statewide. To qualify for the ballot, supporters must collect signatures from 10% of Nebraska’s registered voters, along with 5% support in at least 38 of the state’s 93 counties.
2. Statutory Petition
The second petition outlines how online sports betting would operate if legalized. Key details include:
- Online wagering would run through licensed horse racing tracks
- Oversight would fall to the Nebraska Racing and Gaming Commission
- Operators must host their platforms on servers physically located in Nebraska
- Each operator could offer no more than two online platforms
This petition requires signatures from 7% of registered voters, plus the same county‑level distribution requirement.
Both petitions must be completed by July 3 to appear on the November ballot.
Major Industry Support Behind the Push
The initiative is backed by WarHorse Casinos and the Sports Betting Alliance, two of the most influential groups in the state’s gaming sector.
WarHorse CEO Lance Morgan confirmed that several major national operators are already prepared to partner with his company if online betting becomes legal, including:
- DraftKings
- FanDuel
- BetMGM
- Circa Sports
- Bet365
Why Nebraska Is Turning to Ballot Initiatives
Nebraska currently allows in‑person sports betting only, and only at licensed casinos. Online wagering has been repeatedly blocked in the state legislature, despite multiple attempts.
Earlier this year, lawmakers introduced a constitutional amendment to authorize online sports betting - but it failed to gain enough support after limited debate. With legislative momentum stalled, supporters have shifted their strategy to direct voter action.
If both petitions succeed and voters approve the measures in November, Nebraska regulators would have until June 1, 2027, to finalize rules and launch online sports wagering.

Signature collection begins immediately. If supporters meet the July 3 deadline:
